PUBLIC NOTICE CITY OF ENCINITAS NOTICE OF FUNDING AVAILABILITY  Department of Housing and Urban Development  Community Development Block Grant Program  Beginning January 8, 2024, the City of Encinitas is soliciting proposals for projects, activities, and programs under the federal Community Development Block Grant Program (CDBG) for the Fiscal Year (FY) 2024-25 (July 1, 2024– June 30, 2025). The CDBG program is funded by the U.S. Department of Housing and Urban Development (HUD). The City of Encinitas is an entitlement community and receives CDBG directly from HUD to address local community development needs. The City of Encinitas anticipates an estimated annual allocation of $297,673 for FY 2024-25 with estimated available funds in the following categories:  • Public Services $  44,650 • Program Administration  $  39,534 • Fair Housing Services  $  20,000 • Facility Improvements, Residential Rehabilitation, and CIP Projects $193,489 Applications are available beginning on Monday, January 8, 2024 on the City of Encinitas website at: https://www.encinitasca.gov/government/departments/development-services/policy-planning-housing/housing/housing-resources. CITY OF CARLSBAD ORDINANCE NO. CS-462. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING CARLSBAD MUNICIPAL CODE CHAPTER 2.04 – ELECTED OFFICIALS,  SPECIFICALLY SECTION 2.04.030 – DUTIES OF MAYOR AND SECTION 2.04.040 – ELIGIBILITY FOR OFFICE WHEREAS, Carlsbad Municipal Code Section 2.04.030 identifies the duties of the Mayor; and WHEREAS, Section 2.04.030(B) specifies that the Mayor signs all written contracts and conveyances made or entered into by the city; and WHEREAS, the City Council wishes to clarify that the City Council may delegate such authority to the City Manager or designee; and WHEREAS, Section 2.04.040 identifies the eligibility criteria for elected officials in the city; and WHEREAS, Section 2.040.040(A) should be amended to reflect the provisions in state law that prohibit people convicted of certain crimes, including felonies, from holding public office; and WHEREAS, the position of City Treasurer is responsible for carrying out financial, accounting, economic and banking responsibilities for the city; and WHEREAS, it is in the best interest of the city that only candidates qualified to carry out the duties and responsibilities of the position of City Treasurer be eligible to hold the office of City Treasurer; and WHEREAS, the City Council wishes to provide clear and verifiable eligibility criteria for the position of City Treasurer. NOW, THEREFORE, the City Council of the City of Carlsbad, California, ordains as follows that: Section I: The above recitations are true and correct. Section II: Carlsbad Municipal Code Section 2.04.030 is amended to read as follows: 2.04.030 Duties of Mayor. A. The Mayor is a City Council Member with all the powers and duties of a City Council Member. The Mayor may make or second motions and otherwise participate fully in the workings of the City Council. The Mayor shall vote on all questions. Whenever the vote is taken by means of a roll call, the Mayor’s name shall be called last. B. The Mayor shall sign: 1. All warrants drawn on the city treasury. 2. All written contracts and conveyances made or entered into by the city for which the City Council is the awarding authority as specified in Chapter 3.28. 

3. All instruments requiring the city seal. The City Council may by ordinance authorize other officers of the city to sign such documents if the Mayor and Mayor Pro Tempore are both absent or unable to act.  C. The Mayor shall be the official head of the city for all ceremonial purposes, and shall perform all other duties as may be prescribed by resolution or ordinance. D. Notwithstanding Section 2.04.030(B)(2), the City Council may by ordinance or resolution authorize the City Manager or designee to sign any written contract or conveyance on behalf of the city.  Section III: Carlsbad Municipal Code Section 2.04.040 is amended to read as follows: 2.04.040 Eligibility for Office. A. To be eligible to hold office as Mayor, City Council Member, City Clerk or City Treasurer, a person must be an elector of the city at the time nomination papers are issued and must not have been convicted of a felony or other crime rendering the person ineligible under state law to hold public office. B. To be eligible to become a candidate for the office of City Clerk, a person must meet one of the following minimum criteria at the time nomination papers are issued: 1. The person must have obtained the designation of Certified Municipal Clerk from the International Institute of Municipal Clerks. 2. The person must have two years of full-time, salaried work experience in either business administration or public administration and possesses a bachelor’s degree from an accredited college or university. C. To be eligible to become a candidate for the office of City Treasurer, a person must meet the following minimum criteria at the time nomination papers are issued: 1. The person must have a four-year college degree majoring in business administration, public administration, accounting, finance or economics. 2. The person must have four years of financial work experience. 3. In lieu of the work experience required in the preceding subsection (2), the person may have one of the following: a. A valid certificate from the California State Board of Accountancy to practice as a Certified Public Accountant; b. A valid Chartered Financial Analyst credential or a Certificate in Investment Performance Management from the CFA Institute; c. A valid Certified Investment Management Analyst certification from the Investments & Wealth Institute; or d. A valid Certified California Municipal Treasurer designation from the California Municipal Treasurers Association. D. Notwithstanding California Government Code Section 53227 or any successor statute regulating the eligibility of a local agency employee to serve on the local agency’s legislative body, the Mayor or a City Council Member may simultaneously serve, without compensation, as a city volunteer subject to all applicable federal and state laws, municipal ordinances and rules and regulations, including conflict of interest and ethics laws, ordinances, rules and regulations.  EFFECTIVE DATE:  This ordinance shall be effective thirty days after its adoption; and the City Clerk shall certify the adoption of this ordinance and cause the full text of the ordinance or a summary of the ordinance prepared by the City Attorney to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen days after its adoption. CITY OF ENCINITAS PUBLIC NOTICE OF ORDINANCE INTRODUCTION ORDINANCE NO. 2023-07 NOTICE IS HEREBY GIVEN that the City Council of the City of Encinitas has introduced Ordinance No. 2023-07 “An Ordinance of the City Council of the City of Encinitas, California, adding Chapter 9.85 “Shopping Carts” to the Encinitas Municipal Code to Require Containment of Shopping Carts on Business Premises and Making it Unlawful to Remove a Shopping Cart Therefrom.”   Proposed Ordinance No. 2023-07 establishes two enforceable components:   • It is unlawful to remove a marked shopping cart from a premises or to be in possession of a marked shopping cart. • It is unlawful for a shopping cart owner (as defined in the ordinance) to allow a shopping cart to be abandoned or remain unattended. In addition, the proposed ordinance language builds out extended shopping cart owner responsibility in several ways, including provisions requiring the following: • Shopping cart ownership identification on all carts. • Installation of shopping cart removal warning signs. • Use of physical containment measures OR a shopping cart retrieval service. • After hours shopping cart security. • Submittal of a shopping cart containment plan to the City of Encinitas. CITY OF ENCINITAS PUBLIC NOTICE 2024 SCHEDULED VACANCIES ON CITY COUNCIL APPOINTED COMMISSIONS   NOTICE IS HEREBY GIVEN that the City of Encinitas is accepting applications for appointment to City Commissions. Applicants must have resided as a registered voter in either Cardiff or Olivenhain for no less than six months prior to appointment and maintain residency and voter registration in Cardiff or Olivenhain while serving on the Commission. The Mobility and Traffic Safety Commission shall study and report to the City Council upon any matter referred to it by the City Council. The Mobility and Traffic Safety Commission shall have advisory responsibility in regard to mobility and traffic safety issues. A. It is the duty of this Commission to serve as a liaison between the public and the City Council, and to conduct analyses and provide recommendations to the Council on matters related to safety and mobility of all modes of transportation. B.  If the recommendations of the Mobility and Traffic Safety Commission are to modify existing traffic controls, devices, markings, or measures, or install new controls, devices, markings or measures, then those recommendations shall be included with a report by the City Traffic Engineer or his/her designee in an agenda item to the City Council. C.  If the recommendations of the Mobility and Traffic Safety Commission are to not modify existing traffic controls, devices, markings, or measures nor to install new traffic controls, devices, markings or measures, then these recommendations shall be included in a report by the City Traffic Engineer or his/her designee to the Council for information only. The Commission decision can be reviewed by Council if an appeal is filed or by Council request. (See Chapter 1.12.) D. The City Council may refer to the Mobility and Traffic Safety Commission requests to review and prepare recommendations on major roadway projects. E.  Powers Delegated to the Mobility and Traffic Safety Commission to be advisory. Nothing in this chapter shall be construed as restricting or curtailing any of the powers of the City Council, or as a delegation to the Mobility and Traffic Safety Commission of any of the authority or discretionary powers vested and imposed by law in the City Council. The City Council declares that the public interest, convenience, and welfare require the appointment of a Mobility and Traffic Safety Commission to act in a purely advisory capacity to the City Council for the purpose enumerated. Any power herein delegated to the Commission to adopt rules and regulations shall not be construed as a delegation of legislative authority but purely a delegation of administrative authority. PARKS AND RECREATION COMMISSION:  Three (3) appointments to be made for three- year terms ending March 1, 2027. Applicants must have resided as a registered voter in either Cardiff or Old Encinitas for no less than six months prior to appointment and maintain residency and voter registration in Cardiff or Old Encinitas while serving on the Commission.  The Planning Commission shall perform such duties as may be specified by ordinance or resolution of the City Council or by the laws of the State of California. Further, the Planning Commission shall study and report to the City Council upon any matter referred to it by the City Council and shall keep the City Council currently advised of all matters pending, and shall furnish any special information, reports or materials which the City Council may request. The Planning Commission shall make a final determination as authorized by the Code for the following applications:  Coastal Development, Conditional Use Permit (Major), Tentative Tract Map, Zoning Code Interpretation, Application for project in more than one Community Planning area, and other applications and duties as required by the Code. In addition, the Planning Commission shall make recommendation to the City Council as authorized by the Code for the following applications: General Plan Interpretation, General Plan Amendment, Zoning Code Amendment, Zoning Map Amendment, Specific Plan, and other applications as required by the Code. SENIOR CITIZEN COMMISSION: Three (3) appointments to be made for three-year terms ending March 1, 2027. URBAN FOREST ADVISORY COMMITTEE*: Three (3) appointments to be made for three-year terms ending March 1, 2027.  Terms expiring are: • Brian Bishop, appointed June 28, 2017, Term 1 • Mark Jenne appointed June 28, 2017, Term 1 • Carol Parker appointed June 28, 2017, Term 1 The UFAC is composed of members of the community with interest and expertise in urban forestry.  This group advises and works together with the City Arborist to review and provide comments on City plans and policies related to urban forestry, including updates to the various aspects of the City’s Urban Forest Management Program and Administrative Manual, and, shall among other things: review and provide comments on Tree Plans prior to consideration by the City Council; review and provide comments on the Approved Tree Species Master List prior to consideration by the City Council; review and provide comments to the City Arborist on proposed City Tree removals except in the case of emergency removals; advise City Staff regarding programs of public outreach and education in order to promote public understanding of the City’s urban forest, including programs to celebrate and promote Arbor Day; review and consider Heritage Tree applications in consultation with the City Arborist, and shall make recommendations to the Planning Commission; and review and provide comments to the City Arborist on proposed changes to the City’s Urban Forest Management Program. *Effective September 27, 2023, Encinitas Municipal Code Section 2.30.020 Terms and Term Limits shall apply to this committee. General Information (for complete text see Chapter 2.30 of the Municipal Code) • Persons appointed to a City board, commission, or committee serve at the pleasure of the City Council. • All Commissions with the exception of the Youth Commission shall have three-year staggered terms of office. The Youth Commission shall have a one-year term of office. • All Commissions, with the exception of the Youth Commission, shall have term limits of two (2) consecutive full terms of office. After reaching the term limit, a person must sit out one appointment cycle before reapplying to the same City Commission. Upon terming out of one Commission, a person may apply to a different City Commission. • Commissioners may not serve on more than one commission at a time.
