OCEANSIDE — A Los Angeles man who racked up three driving under the influence charges within a month last year was sentenced to jail Oct. 16.
Andrew Brian Davis, 45, received one year in county jail and five years formal probation in lieu of his plea in July to a single count of DUI with injury stemming from three drunken driving arrests, all of which involved accidents, during April and May 2007 in Oceanside.
While two of the accidents — on April 24 and May 30 — only involved parked cars, the May 23 accident was a collision that injured a woman.
During the sentencing, Aida Arriaga told the judge she still has difficulty working due to neck and back injuries she sustained from the accident. Despite her injuries, which make it hard for her to even pick up her son, she asked that Davis be given a “fair sentence.”
Prosecutors had requested a two-year prison sentence citing the severe impact that the accident has had on Arriaga and her family.
Following the hearing, Arriaga declined to comment further on the sentencing.
Davis, whose blood alcohol level for the DUIs was .30, .18 and .13. respectively, said he started drinking heavy because of stress relating to the health and financial well-being of his aging mother who relocated to Oceanside in 2007. His mother was in the vehicle during the two May incidents; however, she wasn’t injured in either accident.
“I lost my vigilance and that led to a loss of discipline which segued directly to this point in my life,” Davis said in a letter to the court. “I know that by digging down deep through my life, one layer at a time, I feel as though I’ve definitely learned.”
In addition to Alcoholics Anonymous, Davis, who has no prior record, said he’s also seeking psychological counseling. Following his release from jail, Superior Court Judge Timothy Casserly ordered Davis to a residential treatment facility
