APNs 215-020-07, 21, 22, and 44 thru 47. 33° 6’ 34” 117° 16’ 36” Project Description: The project site is located within the southwest quadrant of the City of Carlsbad, south of Palomar Airport Road, west of El Camino Real, and bisected in the northerly portion by the future Poinsettia Lane Reach E circulation element roadway. The site is made up of seven separate lots and is approximately 61 acres in size. The northerly 20 acres has been previously disturbed by agricultural practices and grading for the future extension of Poinsettia Lane. The remainder of the site is natural habitat with the exception of an SDG&E transmission corridor and access road and other minor trails and illegal encampments. A city pedestrian trail is proposed within the existing SDG&E easement. The entire site burned during the Poinsettia wildfire in May 2014. Adjacent uses include open space and multi-family residential to the north, open space to the south, open space to the east, single family residential and the western terminus of Poinsettia Lane to the southeast, and multi-family housing and Ambrosia Lane to the west. The project is within the Airport Influence Area of McClellan Palomar Airport. The entire project site is within the limits of Local Facilities Management Zone 21 and in the Mello II Segment of the Local Coastal Program. The applicant is proposing a 123 unit single family detached condominium project. The applicant has applied for a number of entitlement applications including; a General Plan Amendment which would adjust the boundaries of the open space and residential land use designations; a Zone Change from Limited Control (LC) to One family Residential (R-1) and to reflect Open Space changes; a Local Coastal Program Amendment; a Vesting Tentative Tract Map; a Planned Development application for the individual ownership of units and subdivision of the residential area; a Site Development Plan (affordable housing component); a Hillside Development Permit and a Habitat Management Plan permit. The project will be developed at a density of approximately 4.8 dwelling units per acre, which is consistent with the R-4 residential General Plan Land Use designation of the site. A maximum of 15% of the homes will have a second dwelling unit to meet a portion of the projects affordable housing requirement. The remainder will be met by the purchase of off-site housing credits. The area proposed to be developed is the previously disturbed agricultural area on the easterly and westerly side of the future extension of Poinsettia Lane between Cassia Road and Oriole Court. This 20 acre parcel known as the Maldonado property was previously used for agricultural purposes and some grading has been completed for the future extension of Poinsettia Lane. An additional seven acres of the Namikas property which is contiguous and southerly of the Maldonado parcel is also part of the western development footprint. The Sudduth and Kavane properties (30 acres) further to the south are to remain in open space, except for an eastern portion of the Sudduth property which will be impacted by the completion of Poinsettia Lane. The eastern portion of Poinsettia Lane will require a bridge to span a canyon to preserve the maximum width possible for a habitat wildlife corridor. No access or dwelling units are proposed off of Ambrosia Lane. Potential Environmental Effects may include: Aesthetics/Grading, Agriculture, Air Quality, Biological Resources, Cultural /Paleontological Resources, Geology/Soils, Greenhouse Gas Emissions, Hazards/Hazardous Materials, Hydrology/Water Quality, Land Use Planning, Noise, Population and Housing, Public Services, Transportation/Circulation, Utilities and Service Systems, Mandatory Findings of Significance. An Initial Study was not prepared for this project. Pursuant to CEQA Section 21080.4(a) and Section 15082 of the State CEQA Guidelines, responsible and trustee agencies and members of the public are asked to provide written comments regarding the scope and content of the EIR. Therefore, we need to know your views, or the views of your organization, regarding the effect this project might have on the environment and your suggestions for ways the project could be revised to reduce or avoid any significant environmental impacts. Nevertheless, in an abundance of caution, to maintain local control, the City Attorney (and League of California City Officials) recommends that such authority, prohibiting medical marijuana dispensaries and related uses, including cultivation, be formally re-affirmed and confirmed as listed in Ordinance 2015-19. CITY OF ENCINITAS PUBLIC NOTICE OF ORDINANCE ADOPTION ORDINANCE NO. 2015-16 NOTICE IS HEREBY GIVEN that the City Council of the City of Encinitas has adopted Ordinance No. 2015-16 entitled, “An Ordinance of the City Council of the City of Encinitas, California, adding Chapter 1.10 to the Encinitas Municipal Code to include provisions for a voluntary mediation program for land use and development projects.” The City Council introduced Ordinance 2015-16 at a meeting held on December 9, 2015. This ordinance adds Chapter 1.10 to the Municipal Code outlining a voluntary mediation program for land use and development projects where citizens and project applicants are able to mediate any remaining issues following the approval of a private development project. The mediation program would be voluntary and offer an opportunity for the parties to resolve outstanding differences prior to initiation of a formal City Council appeal process. SAN ELIJO JOINT POWERS AUTHORITY LEGAL NOTICE OF ENVIRONMENTAL REVIEW AND COMMENT PERIOD Public Review Period: January 8, 2016 to February 8, 2016. Notice is hereby given that a 30-day public review and comment period has been established pursuant to the California Environmental Quality Act (CEQA) for a draft Mitigated Negative Declaration, which has been prepared for the proposed project as identified below. PROJECT NAME: San Elijo Land Outfall Replacement Project APPLICANT: San Elijo Joint Powers Authority (SEJPA) LOCATION: The project site is located in the Cardiff by the Sea community within the southern portion of the City of Encinitas west of Interstate 5. The site extends from just north of Manchester Avenue within the San Elijo Water Reclamation Facility (SEWRF), southwest across San Elijo Lagoon, and to Cardiff State Beach. DESCRIPTION: The SEJPA proposes to replace the land outfall portion of the SEWRF outfall system that extends between the SEWRF and the beach. The proposed alignment of the new land outfall would be slightly different from the existing outfall alignment in order to accommodate a trenchless construction method, horizontal direction drilling (HDD). The new pipeline would extend west approximately 80 linear feet from the existing outfall system within the existing SEWRF access road, under the access road, and across an existing flood control channel in an open trench. From there, it would turn southwestward for approximately 2,500 linear feet under Manchester Avenue, the Visitor Center parking lot, San Elijo Lagoon, railroad tracks, Coast Highway 101, and connect to the existing outfall located beneath the Cardiff State Beach. Installation of this segment of the pipe would be conducted utilizing HDD. The new pipe would tie into the existing ocean outfall pipe located approximately 15 feet below ground level at the beach. Once the new outfall is complete and operational, the existing land outfall pipeline would be dewatered, its ends would be capped, and it would be abandoned in place. ENVIRONMENTAL STATUS: The SEJPA has performed an Environmental Initial Study, which has determined that with mitigation measures, no significant environmental impacts would result from the proposed project. Therefore, a Mitigated Negative Declaration is recommended for adoption. The draft Mitigated Negative Declaration is available for public review from January 8, 2016 to February 8, 2016. Written comments regarding the adequacy of the draft Mitigated Negative Declaration must be received by the SEJPA at the address provided below by 5:00 p.m. on February 8, 2016. A final environmental document incorporating public input will then be prepared for consideration by decision-making authorities.
