Suspect arrested for assault on officers

CARLSBAD — Police arrested Benjamin Fogelhut in the 200 block of Saxony Road in Encinitas on Aug. 25 on charges related to an incident at a Vons in Carlsbad.
On Aug. 13, two on-duty, plain clothes State of California Alcohol
Beverage Control Investigators attempted to arrest a shoplifting suspect in front of the Vons located at 6951 El Camino Real. The two officers were able to handcuff the suspect and notify the Carlsbad Police Department. While Carlsbad Police Officers were enroute to the location to assist, the suspect attacked the two state officers. The suspect caused injury to both officers and fled the location, running behind the Vons. The suspect escaped wearing handcuffs. The two injured investigators were treated and released at a local hospital.
The Carlsbad Police Department conducted an investigation into this incident and identified Fogelhut as the suspect who assaulted the investigators and escaped.
Fogelhut was booked into the Vista Detention Facility with charges of assault with deadly force on a peace officer, violently resisting arrest, and robbery. Fogelhut’s bail was set at $240,000.

    I’ve known Ben since he was child growing up in Encinitas. He’s a good kid, and a gifted mathematician and artist. His passion is surfing, yet he sold his surfboard for drugs. He’s got a disease. This is why the community can’t afford to have places like the McDonald’s Center go out of business.
